Individuals do not have emergency powers under section 330 of the RMA unless directed by a local or consent authority; for example, Environment Canterbury or Civil Defence. This means that any works you undertake during an emergency must comply with the same rules and regulations that apply outside of emergency situations.
Section 330 of the RMA is used by local authorities, consent authorities, and network utility operators to protect public infrastructure in the event of an emergency. Section 330 allows these authorities to conduct emergency works when there is an adverse effect on the environment which requires immediate preventive or immediate remedial measures or when any sudden event is likely to cause loss of life, injury or serious damage to property.
