OPERATIVE: This plan sets out issues relating to the protection, development and enhancement of the Coastal Marine Area and the coastal environment. Plan Change 1 and 2 to Chapter 8

Plan Changes 1 and 2 to the Regional Coastal Environment are operative from the 20th August.

These two Changes cover existing lawfully established activities in the Coastal Marine Area and mean that such activities do not need to apply for consent to occupy the CMA. In addition, it becomes a permitted activity to place a swing mooring in a designated swing mooring area (subject to bylaws).

Immediate Plan Changes to the Regional Coastal Environment Plan

In order to give effect to Policy 29 of the New Zealand Coastal Policy Statement, Environment Canterbury is changing the Regional Coastal Environment Plan by removing all references to Restricted Coastal Activities (RCAs).  This means there will be no requirement for any resource consent application in the Coastal Marine Area to be treated as an RCA and the particular Hearings process which applied to RCAs will no longer be necessary. However, this will not change the requirement to apply for a resource consent for an activity that was previously an RCA.

Changes 1 and 2 to the Regional Coastal Environment Plan
On 31 May 2007, the Canterbury Regional Council decided to publicly notify Proposed Plan Changes 1 and 2 to the Regional Coastal Environment Plan.

 In June 2008, the Hearing Committee reported on Submissions to the Plan Changes.

On 31 May 2007 the Canterbury Regional Council decided to publicly notify Proposed Plan Changes 1 and 2 to the Regional Coastal Environment Plan and adopted the associated Section 32 report on the proposed changes.

Rule 8.2 in the plan has been retained.  It requires a resource consent as a Discretionary Activity for which discretion is restricted, for the placement of a new swing mooring in a designated Swing Mooring Area.  Similarly retained, is Rule 8.5 which requires a resource consent as a Non-complying Activity for the placement of a new swing mooring outside a designated Swing Mooring Area.

The new permitted activity provisions that are proposed will avoid the need for owners of existing swing moorings and other lawfully established structures to obtain resource consents to occupy the coastal marine area.

Plan Change 4

Plan Change 4 to the Regional Coastal Environment Plan is operative from the 11th June 2011.

This Plan Change seeks to exempt the existing fuel tanks located at South Bay, Kaikoura, from Rule 9.3, which prohibits storage of hazardous substances (in this instance petrol and diesel) within the Coastal Hazards Zone. The existing fuel tanks form an important part of the operation of the Kaikoura Marine Facilities Area. The Private Plan Change proposes to make the storage of fuel in the existing tanks a Restricted Discretionary Activity so that a resource consent can be sought for their ongoing use.
