Proposed Flood Protection & Drainage Bylaw 2012

Hearings for the Proposed Flood Protection and Drainage Bylaw 2012 were held from Monday 29 to Wednesday 31 October 2012. Officers have prepared a response to specific requests for further information from the Commissioner. The Hearings Commissioner Sharon McGarry is currently deliberating on the evidence presented and a recommendation will be prepared in due course.

The Canterbury Flood and Drainage Protection Bylaw became operative on 2 April 2013

The Proposed Bylaw will apply to all rivers, drains and floodways where the Canterbury Regional Council has established rating districts for drainage and flood control schemes and will provide for the integrity and effective operation of flood protection and flood control works owned or controlled by the regional council.

The Bylaw will not apply outside these rating districts. Neither will the bylaw apply to any privately managed drainage or flood protection schemes, nor to those managed by other local authorities.

The Proposed Bylaw has been prepared under the Local Government Act 2002 to replace former bylaws for the management of drains and watercourses under the Transitional Regional Plan which ceased to have effect in 2011 when the Natural Resources Regional Plan became operative.

An independent hearing Commissioner has been appointed to hear and make recommendations on the submissions received on the Proposed Bylaw. The hearing was scheduled and took place on the 29-31st of October 2012.
